BeatMike.Com promotes and conducts tournaments ("Tournament") in which players win prizes by predicting the results of various sports events. By participating in the BeatMike Tournament, You and all players agree to the following. 1. By using, registering and/or participating in Tournaments on BeatMike.com, You agree to all the terms and conditions outlined in the Player Agreement ("Agreement"). This Agreement is between You (referred to as "You", "Your" and/or "Player"), and us, BeatMike.Com and its parent company, Win Win Promotions, LLC, an Arizona Limited Liability Company (referred to as "We", "Us", "Our", "Win Win Promotions, LLC", and/or "BeatMike.Com").
1.1. CURRENT PRIZES: Based on the Terms of this Agreement, we are currently paying $250 to the winner of each Tournament. We will pay $1,000 to the winner of a given Tournament if the winner guessed all the 15 games correctly AND the winner predicted the exact score of the tie breaker.
2. Privacy and Publicity Policy Regarding Use of Personal Information
2.1. We promise NOT to share Your information with any third party. We do NOT give your email address or personal information to any third party or use it for any reason except when We need to communicate with you regarding the BeatMike.com Tournaments and/or prizes and/or promotions of BeatMike.com
2.2. However, if You win and accept a Prize, We reserve the right to publicize Your full name, home town and state (with no other contact information), Your photo, and a quote from You about playing and winning the BeatMike.com Tournament.
2.3. Also by accepting Your prize, where allowed by law, all winning players and You grant Us exclusive permission and hereby release us to use your names, characters, likenesses, photographs, and voices in connection with promotion of this or Our related Tournaments and on the BeatMike.com website and You hereby waive any claims to royalties or remuneration for such use and thereby accepting Your prize as full payment for said permission and release.
3. Gambling Prohibition
3.1. BeatMike.com and the Tournaments are strictly for entertainment purposes and may not be used in connection with any form of gambling.
3.2. Promotion of gambling sites from this site is strictly prohibited.
3.3. There is no purchase necessary, your information will never be sold to a third party and there are no fees to join BeatMike.com or play Our Tournaments.
4. Disclaimer of Affiliations, Endorsements, and Guarantees
4.1. Beat Mike.Com is independently owned and operated and is not affiliated with, and specifically disclaims any affiliation or relationship with any professional, college, high school, or other amateur sports team, individual, or any governing or organizational body thereof.
4.2. Beat Mike.Com is independently owned and operated and unless otherwise specifically stated, is not affiliated with, and specifically disclaims any affiliation or relationship with the advertisers on BeatMike.com. All information and offers provided by the advertisers is solely the responsibility of the advertisers. We do not verify nor endorse any information or offers advertised on BeatMike.com.
4.3. We make no guarantees with respect to BeatMike.com advertisers and/or their products, services and/or their policies regarding treatment of your personal information should you provide it to them.
5. Eligibility
5.1. Registration on BeatMike.com and/or participation in BeatMike Tournaments is void where prohibited.
5.2. By using BeatMike.com, You represent and warrant that all registration information You submit is truthful and accurate and that You agree to accept full responsibility for maintaining the accuracy of such information.
5.3. You further represent and warrant that if you are under 18 years of age, You have the consent of a parent or legal guardian to play the Tournament, and that Your use of BeatMike.com shall not violate any applicable law or regulation. Should You become a prize winner, proof of age and/or legal consent will be required to claim and receive Your prize.
5.4. Your membership is solely for Your personal use, and You shall not authorize others to use your account, including your password or email address.
5.5. You are solely responsible for all content published or displayed through Your account, including any email messages, and for Your interactions with other players.
5.6. Player must register by providing their zip code, login (chosen by player), player's email address, and password (chosen by player) to be used whenever playing the Beat Mike Tournaments.
5.7. Player is limited to only one entry per Tournament.
5.8. Player may not use alias names, multiple email addresses / logins, or other means to attempt to fool or trick the system, and any player caught doing so may be removed from the game and/or be declared ineligible for that Tournament.
6. Tournament Rules
6.1. The winner(s) is/are determined in accordance with the following rules. While We have attempted to cover every conceivable possibility, in the event of an occurrence that is not specifically covered by Our published rules, We will make the final decision using Our best judgment and discretion with respect to fairness and intent, and You agree that Our decision(s) shall be binding.
6.2. All prizes will be paid and/or valued in United States Dollars (USD).
6.3. This game is FREE to You and all players. No purchase is necessary to participate or win. Purchase does not increase your chances of winning. Odds of winning depend upon the number of participants. Void where prohibited.
6.4. Log on to the BeatMike.com and click on the "Play" icon.
6.5. Follow the onscreen instructions.
6.6. You may only enter one time per each Tournament. Individuals who play under multiple accounts for this game are not eligible to win prizes.
6.7. Once You are properly registered, You may log on, make your selection of the winning teams in the games scheduled to be played during the current Tournament.
6.8. You select Your choice of who will win each of the games shown on a published list of sports events on the official BeatMike.com Tournament website. For example, there may be 15 baseball or football games in a given Tournament. You will select the team that You predict will win each of the 15 listed games.
6.9. After You choose all the winners, You will also predict a "Total Score" for the Tournament. This is only used as a tie breaker when necessary to determine a winner as described below. The total score is the combined scores of both teams in all the games for the given Tournament - whether expressed as points, runs, goals, or other scoring criteria used in the particular event.
6.10. A tournament is defined as 15 games and a tie-breaker. The games may be played on more than one date, but the cut-off for making your picks will be before the beginning of the first game scheduled for the subject Tournament.
6.11. If a game ends in a tie, it will be considered a winning pick for all players, and the total score will be included in the tie breaker calculation for that Tournament.
6.12. If a game postponed or cancelled for any reason, resulting in the game not being completed and recorded as an "official game" on the scheduled date of the game, that game will be considered as "No Contest" and it will be recorded as a winning pick for all players. No score will be added to the total calculation of the tie-breaker score.
6.13. In the event there are two games played on the same day of a scheduled tournament (for example a doubleheader in baseball), the first game played in full on that date will be considered as the active Tournament game - even if it was a make up game from a previously scheduled game that was postponed. However, this does not apply if the first game is a continuation of a game that was suspended, and is being picked up from the point of suspension…it must be a complete game beginning and ending on the Tournament date.
6.14. Please note that any game left blank in any given Tournament will be automatically scored as an incorrect answer. If you don't complete the tie-breaker score and the tie-breaker becomes necessary to determine the winner, your tie-breaker will be calculated as being zero. To avoid this, You must pick a team for every game on the Tournament schedule and pick the tie-breaker score.
6.15. Each game in the tournament is sponsored, and You may have the option print a special offer / coupon from a sponsor, or visit a sponsor's website by clicking on the advertiser's website link. This is your choice; a response to a sponsor's offer does not affect your chances of winning.
7. Determination of Winners
7.1. The winner is determined by the player with the most correct winning predictions.
7.2. However, it is expected that there will be a number of players who will tie in picking the most winning teams. These players will be included as winners of the first cut.
7.3. Winners of the first cut will move into a second cut tie breaker round. For example, if the highest number of correct predictions is 14 out of 15 games, all players with 14 correct predictions will make the first cut and be entered into the second cut tie breaker.
7.4. The winner(s) of second cut tie breaker is/are determined by the player(s) who come(s) the closest to predicting the combined total of the scores of all of the games on that Tournament list. For example, if there are 15 games on the list, the combined total would be the total scores for all 15 of the games on that Tournaments list. If that total is 1728, the player(s) who come(s) the closest to 1728 would be declared that Tournament's winner(s)
7.5. In the event a tie still exists after the second cut, the prize money will be divided equally among the remaining winning players.
8. IMPORTANT TO Claim Your Prize
8.1. We specifically save Your email address, password and Your zip code before the beginning of each Tournament.
8.2. All winning entries will be manually checked against Our database to confirm that a winning player did not enter multiple times for that week's Tournament.
8.3. Winners will be notified by email and posted in the results area of the BeatMike.com website in the following manner: Player's Zip Code, Number of Winning Picks, and Tie Breaker Total Score.
8.4. To claim Your prize, You must email us and request your prize.
8.5. We may then request that You email us Your name, phone number, email address, full mailing address, Your photo, and a statement.
8.6. We may further request that You mail us a copy of Your valid identification (ID) with your current mailing address and Your zip code. You may also be required to sign Our release form to claim the prize.
8.7. We may substitute prizes, amend the rules or discontinue the Tournament at any time as announced on Our website(s).
8.8. We will issue Your prize and mail it to the address on Your ID ONLY if the Zip Code matches the Zip Code that was saved with Your profile on the date You entered the Tournament that you won. If Your Zip Code does not match the Zip Code on Your ID, We will not issue You the prize.
8.9. You agree that if We issue you a prize, we may publish Your full name, hometown, and state, Your photo, and a statement on Our website and use Your information in accordance with the privacy section of this Agreement.
8.10. Please allow up to eight (8) weeks to process all prizes.
9. Build a Team and Boost Your Odds of Winning
9.1. With our Tell-a-Friend Program, You are encouraged to recruit other players on Your team to increase Your odds of winning.
9.2. Any Player who builds a team by recruiting other players receives duplicate prizes every time one of their team members wins. (Note: This does not apply to the Perfecta Prize. Only the winner of the Perfecta wins the Perfect Prize. However, you still win the Tournament Prize.)
9.3. For example, if You recruit other players and one of them wins a Tournament's prize, you will receive a prize that is equal to that of the player You recruited. If one of your team members wins $250, You win $250.
9.4. To be eligible to receive prizes under this section of the Tournament Rules, at the time the recruited player registered on the BeatMike.com website, he or she must have listed Your email address as the login of the person who referred them to Us.
9.5. The same criteria for prize eligibility described in section 8 of this Agreement will apply for claiming and receiving prizes under this section, as well.
10. Deadlines
10.1. All entries must be submitted no later than the closing date and time posted on the website for that Tournament, with no exceptions. If there is no date and time mentioned, the beginning of the earliest game in the Tournament shall be the deadline to pick all the games in that Tournament.
10.2. All entries are downloaded and saved to a second remote server location after the closing date and time and before the beginning of the first game in each Tournament.
10.3. Winners will be posted on the BeatMike.com website. To claim Your prize, You must email Us and request Your prize no later than four (4) weeks after the date the winner(s) were posted on the BeatMike.com website for the Tournament that You won.
10.4. To claim Your prize, You must mail Us a copy of Your valid ID no later than six (6) weeks after the date the winner(s) were posted on the BeatMike.com website for the Tournament that You won.
11. Disclaimer of Liability for Delivery of Information
11.1. We disclaim all liability for any delays, missed-delivery, loss, or failure in the delivery of any item sent by electronic transmission, or other delivery method.
11.2. We are not responsible for mechanical, technical, electronic, communications, telephone, computer, hardware or software errors, malfunctions or failures of any kind regardless of cause, including: failed, incomplete, garbled or delayed transmission of online entries, traffic congestion on telephone lines, the Internet or at any website or lost or unavailable network connections, which may limit an online entrant's ability to participate in the Tournament, and any injury or damage to entrant's or any other person's computer related to or resulting from participating in or downloading any information necessary to participate in the Tournament.
12. Release
12.1. By participating in the Tournament, each participant, winner and You waive any and all claims of liability against Us, Win Win Promotions LLC, its employees, directors, officers, owners, members and agents, the Tournament's sponsors and their respective employees and agents, for any personal injury or loss which may occur from the conduct of, or participation in, the Tournament, or from the use of any prize.
12.2. In order to receive a prize, participants must sign an official waiver form when provided by Us.
13. Taxes
13.1. Any valuation of any non-cash prize(s) is based on available information provided to Us, and the value of any prize awarded to a winner may be reported for tax purposes as required by law. Each winner is solely responsible for reporting and paying any and all applicable taxes related to the prize(s) and paying any expenses associated with using or redeeming any non-cash prize, which is not specifically provided for in the official rules.
13.2. Each winner must provide Us with valid identification and a valid taxpayer identification number or social security number before any prize will be awarded.
13.3. Non-cash prizes are not transferable, redeemable for cash or exchangeable for any other prize.
13.4. Any person winning over $600 in prizes will receive an IRS form 1099 at the end of the calendar year and a copy of such form will be filed with the IRS.
14. Decisions and Miscellaneous
14.1. By participating in the Tournament, participants and You agree to be bound by the Our decisions.
14.2. We will interpret these rules and resolve any disputes, conflicting claims or ambiguities concerning the rules of the Tournament and Our decisions concerning such disputes shall be final.
14.3. We reserve the right to disqualify any participant or winner and may refuse to award any prize to a person who is ineligible, tampers with the entry process, engages in any conduct detrimental to Us, the Tournament or any other entrant (in each case as determined in Our sole discretion) to lock out any individual whose eligibility is in question, or who We believe has violated any rule, gained unfair advantage in participating in the Tournament, or obtained winner status using fraudulent means, and to cancel, terminate, modify or suspend this Tournament at any time, in our sole discretion.
14.4. If the conduct or outcome of the Tournament is affected by human error, any mechanical malfunctions or failures of any kind, intentional interference or any event beyond Our control, We reserve the right to terminate this Tournament, or make such other decisions regarding the outcome as We deem appropriate.
14.5. All decisions will be made by Us and are final. We may waive any of these rules at Our sole discretion. Any and all improprieties should be reported immediately to info@BeatMike.com.
14.6. CAUTION: ANY ATTEMPT BY ANY PERSON TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE TOURNAMENT IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, WE RESERVE THE RIGHT TO SEEK FROM ANY SUCH PERSON DAMAGES AND ANY OTHER REMEDIES AVAILABLE TO THE COMPANY TO THE FULLEST EXTENT PERMITTED BY LAW.
14.7. We disclaim any responsibility to notify participants of any changes in any aspect related to the conduct of the Tournament other than by posting said changes on the BeatMike.com website.
14.8. We may change the terms of this Agreement at anytime at Our sole and absolute discretion without any notices.
14.9. There will be no other compensation and/or commissions paid to any Player unless a written Salesperson Agreement is signed and executed between You and Us.
14.10. Written copies of these rules are available during normal business hours at the business offices of Our company and by mail upon written request with a stamped, self-addressed return envelope.
14.11. All entries become Our property and will not be returned. To be removed from our database, send an email indicating your request with the word REMOVE in the subject line to remove@BeatMike.com.
By registering on Our website and/or participating in the Tournament(s) You acknowledge and agree that You have read and agreed to all the terms and conditions of this Agreement, the terms and conditions of use, and Tournament rules.
